General Terms and Conditions of Sale – VALISTORIA TRAVEL

Parties

These general terms and conditions of sale apply to the parties involved, namely on the one hand, the Company, named Clémence NOLLET – VALISTORIA TRAVEL, whose registered office is located at 15 rue des Oliviers, 83600 FREJUS in FRANCE, and registered under SIRET number 93876607800019, hereinafter referred to as “the seller,” “the company,” or “VALISTORIA TRAVEL.” And on the other hand, the individual or legal entity wishing to purchase services or products provided by the Company VALISTORIA TRAVEL.

Article 1: Purpose

These General Terms and Conditions of Sale aim to define the contractual relationships between VALISTORIA TRAVEL and the buyer, as well as the conditions applicable to any purchase of services made online through the website www.valistoriatravel.com and via social media.

The company VALISTORIA TRAVEL provides research services for destinations, transportation, accommodation, and activities at the destination. It also produces a personalized and tailor-made travel journal on a day-to-day basis at the request of the buyer.

The various services are mentioned on the website www.valistoriatravel.com.

The acquisition of a service through this site implies the unconditional acceptance by the buyer of these terms of sale, of which the buyer acknowledges having been informed prior to placing their order.

Before any transaction, the buyer declares, on the one hand, that the purchase of services on the website www.valistoriatravel.com is unrelated to their professional activity and is limited to strictly personal use, and on the other hand, that they have full legal capacity, allowing them to commit under these general terms and conditions of sale.

The client acknowledges having received the necessary advice and information to ensure the adequacy of the offer to their needs.

The company VALISTORIA TRAVEL reserves the right to modify these terms of sale at any time, in order to comply with any new regulations or to improve the use of its site. Therefore, the applicable terms will be those in effect on the date of the order by the buyer.

Article 2: Prices

The prices listed on the product sheets of the online catalog are in Euros (€) and are displayed excluding taxes.

VAT will be added at the current rate (20% as of today) and may be applied at the time of VAT liability option for VALISTORIA TRAVEL’s activity.

The company VALISTORIA TRAVEL reserves the right to modify its prices at any time based on market changes, services, and the range of offers proposed, it being understood that the price listed on the site on the day of the order and on the invoice will be the only one applicable to the buyer.

The displayed prices are calculated based on the number of people, the type of trip, the number of days at the destination, and the research to be conducted. They include two modifications of the trip; any additional modifications will be charged extra. If the client wishes for the travel journal to be printed, this will also incur an additional charge.

Article 3: Contact and Orders

The user can contact the Company VALISTORIA TRAVEL via its website https://www.valistoriatravel.com, by phone, on social media such as LinkedIn, Instagram, and Facebook at the address: valistoriatravel, or by email at clemence@valistoriatravel.com.

The Company VALISTORIA TRAVEL and the user will agree on a phone appointment, referred to as a “discovery call,” which is free and without obligation after the client has filled out the questionnaire indicating their expectations.

The user can thus express their expectations and wishes so that the Company VALISTORIA TRAVEL can better target their needs and establish a personalized travel journal in the event that the user places an order.

Within a maximum period of 48 hours (excluding weekends), the Company commits to providing a quote to the user that corresponds to their needs.

In the event of acceptance of the quote by the user, the Company VALISTORIA TRAVEL will promptly begin the necessary research, whether through the Internet, paper guides, or its personal knowledge and experiences.

Article 4: Payment Terms

When the quote is accepted, the buyer agrees to pay for the service in full. The deadline is defined with the company.

In the absence of payment of the total amount within the agreed timeframe, the Company VALISTORIA TRAVEL reserves the right to cancel or delay the execution of the service.

The payment method proposed to the buyer for ordering and paying for the selected services is as follows:

Bank transfer (subject to prior acceptance by the Company VALISTORIA TRAVEL, the bank details of the Company appearing on the quote and the invoice).

In case of late payment, reminders may be sent by email.

In the event of late payment, penalties may apply at a rate equal to three times the legal interest rate in effect.

Late payment penalties are due automatically the day after the payment date mentioned on the invoice, without any reminder being necessary, according to Article L 441-6 of the Commercial Code.

If payment has not been made after three reminders, the company VALISTORIA TRAVEL reserves the right to permanently stop the service and not provide the travel journal to the client.

A legal procedure with a bailiff will be initiated with notification by registered mail and acknowledgment of receipt.

Article 5: Right of Withdrawal

Under Article L.221-28 of the Consumer Code, the buyer has a period of two hours (2 hours) from the validation of their order to exercise their right of withdrawal.

Any complaint can be made by email at the following address: clemence@valistoriatravel.com.

Article 6: Delivery

The company VALISTORIA TRAVEL will provide the buyer by email with a digital file containing the details of their trip as well as reservation links for transportation, accommodation, activities, and ancillary services according to the specifications defined with the buyer.

The travel journal in paper version will also be available, at the buyer’s request, and may be delivered in person or sent by postal mail. An additional charge will be requested to cover additional costs.

Any modifications to the program may incur costs and will be made after validation of a new quote.

The buyer retains full responsibility for finalizing the reservations (transport, accommodation). The company does not guarantee the smooth running of activities, the success of the stay, the completion of various reservations or their cancellation, or the use of the travel journal.

The company VALISTORIA TRAVEL will not make any reservations on behalf of the buyer for transportation and accommodation.

Article 7: Responsibilities

Considering the nature of the services provided, the obligation that falls upon the company EI VALISTORIA TRAVEL is an obligation of means and not of results.

The seller commits to carrying out the services diligently, in accordance with the rules of the trade and in the best possible manner, under the terms and conditions of the agreement, as well as in compliance with applicable legal and regulatory provisions.

The Company commits to providing the user with three accommodations and one to three activities/visits per day depending on the destination and at the request of the buyer.

Its liability cannot be engaged for any damage resulting from the use of the Internet network such as data loss, intrusion, viruses, service interruptions, or other involuntary problems.

The company VALISTORIA TRAVEL cannot be held responsible for the failure of transportation, accommodation, activities, and ancillary service reservations if the buyer reserves more than 24 hours after receiving their program. Similarly, in the event of difficulties before, during, or after the stay, only the service provider’s liability may be engaged.

The company VALISTORIA TRAVEL cannot be a party to any dispute between the buyer and any of the providers selected for the trip (transport companies, accommodation, excursions, travel agencies, or any other person involved in the proposed trip).

All rates charged by the service providers identified by the company VALISTORIA TRAVEL are indicative. Providers are free to modify, in accordance with their own general terms and conditions of sale, the rates of their services without the responsibility of VALISTORIA TRAVEL being engaged. Its responsibility ends with the complete realization of the travel journal in accordance with what the buyer has ordered.

The Company is a service provider and only offers expertise and advice for organizing trips.

The company VALISTORIA TRAVEL cannot be held responsible for the poor execution of the stay, a cancellation or delay of transportation, climatic, economic, or social issues.

The purpose of the reservation is the responsibility of the buyer.

The company VALISTORIA TRAVEL strives to provide on the site information as accurate as possible. However, it cannot be held responsible for omissions, inaccuracies, and deficiencies in updates, whether caused by its own actions or those of third-party partners providing this information.

Article 8: Intellectual Property Rights

All elements of the website www.valistoriatravel.com are and remain the intellectual and exclusive property of the company VALISTORIA TRAVEL. No one is authorized to reproduce, exploit, or use in any way, even partially, elements of the site in the form of photos, logos, visuals, or text.

Thus, according to Article L122-4 of the Intellectual Property Code (IPC), any representation or reproduction, in full or in part, translation, adaptation, transformation, or arrangement of the work made without the consent of the author or their rights holder is illegal.

The photos present on the website www.valistoriatravel.com or on promotional documents, informational materials, and free online content are the property of the company VALISTORIA TRAVEL or are sourced from royalty-free image banks.

Any reproduction, representation, use, distribution, publication, total or partial modification of the content of the site, for whatever reason, by whatever means, and on whatever medium is strictly prohibited and may constitute an offense of counterfeiting. Counterfeiting is a civil offense (subject to damages) and a criminal offense (punishable by two years imprisonment and a fine of 150,000 euros).

Article 9: Personal Data

The company VALISTORIA TRAVEL is committed to preserving the confidentiality of the information provided by the buyer, which they may transmit for the use of certain services. Any information concerning them is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the user has the right to access, modify, and delete information concerning them.
